Q: How is the rate for Disability Benefits calculated?

A: The benefit for disability is based upon an average of the 8 weeks of earnings prior to the date of disability. Total earnings are divided by the 8 weeks worked (less if that is the case) and multiplied by 50%. The statutory maximum is $170.

Q: What is the FICA report for disability benefits and what does it mean to me as an employer?

A: It is a record of the disability benefits paid to an employee during a given period (month or quarter) and shows the amount withheld from his payments for Social Security and Medicare taxes. New York Lumbermen's Insurance Trust Fund deducts the taxes from the claimant's Disability Benefits checks and pays this amount on a quarterly basis to the government and the amount shown is to be matched by the employer.

Q: Do I pay a premium for Disability Benefits and how does it affect my rates?

A: The premium for disability is $4 per employee per month & will be included in the rate charged per $100 of payroll. Benefits paid under disability have no bearing on your experience rating.
